BUZZSTAR PRIVACY POLICY

This Privacy Policy ("Policy") describes how 51820 LLC, doing business as BuzzStar, and BuzzStar, LLC (collectively, "BuzzStar," "Company," "we," "us," or "our") collect, use, disclose, retain, and protect your personal information when you access or use the BuzzStar mobile application, website, and related services (collectively, the "Service"). This Policy applies to all users, including fans, Influencers, and visitors.
By accessing or using the Service, you acknowledge that you have read, understood, and agree to the practices described in this Policy. If you do not agree, please do not use the Service. This Policy is incorporated into and subject to our Terms of Use.
1. INFORMATION WE COLLECT
We collect information in the following categories:
1.1 Information You Provide Directly
Account Information: When you create an account, we collect your name, email address, phone number, username, profile photo, date of birth, and other information you choose to provide.
Payment Information: When you make or receive payments, we collect transaction details, billing address, and payment method information. Full payment credentials (e.g., credit card numbers) are processed and stored by our third-party payment processors (such as Stripe, PayPal, and Apple Pay) and are not stored directly by BuzzStar.
Communications: When you contact us for support or provide feedback, we collect the content of your messages, your contact information, and any attachments you send.
Influencer Verification: If you register as an Influencer, we may collect additional identity verification information, tax identification numbers, and payout details.
1.2 Information Collected Automatically
Device and Technical Information: We collect device type, model, operating system and version, unique device identifiers, browser type, mobile network information, IP address, language settings, and time zone.
Usage Information: We collect data about how you interact with the Service, including pages and features accessed, video calls initiated or received, call duration, actions taken, timestamps, referring URLs, and in-app navigation patterns.
Location Information: We collect approximate location information derived from your IP address and, with your consent, precise GPS-based location data from your mobile device. You may disable precise location sharing through your device settings, though some features may be affected.
Cookies and Tracking Technologies: We use cookies, pixel tags, web beacons, local storage, and similar technologies to collect usage data, remember preferences, analyze trends, and deliver targeted advertising. See Section 5 for more details.
1.3 Information from Third-Party Sources
Social Media Platforms: If you connect your account to or interact with the Service through social media (e.g., Facebook, Instagram, Google), we may receive your profile information, friend lists, and other data permitted by your privacy settings on those platforms.
Analytics and Advertising Partners: We receive information from Google Analytics, Firebase, and Meta (Facebook) SDK about your interactions with the Service and our advertisements on other platforms.
Payment Processors: We receive transaction confirmation, payment status, and fraud-screening data from our payment partners.
1.4 Video, Audio, and Recording Data
By using the Service, you acknowledge and consent that BuzzStar may automatically record, capture, store, and process all video calls, audio interactions, live streams, and other content transmitted through the Platform. These Recordings constitute personal information and are handled in accordance with this Policy and our Terms of Use (see Section 6 of the Terms of Use for the full license grant and usage rights).
2. HOW WE USE YOUR INFORMATION
We use your personal information for the following purposes:
Providing and Operating the Service: To create and manage your account, process transactions, facilitate video calls, deliver notifications, and provide customer support.
Recording and Promotional Use: To record, store, reproduce, distribute, and publicly share Recordings of video calls and interactions within the app, on our social media accounts (including Instagram, TikTok, YouTube, X, Facebook, Snapchat, LinkedIn, and others), in marketing and advertising materials, on our website, and through any other media channels, as described in our Terms of Use.
Communications and Messaging: To send you transactional messages (e.g., receipts, call reminders), service updates, security alerts, and, with your consent, promotional communications. Messaging features may be powered by Twilio, Inc.
Safety, Security, and Compliance: To detect, prevent, and address fraud, abuse, spam, illegal activity, and security threats; to monitor compliance with our Terms of Use, community guidelines, and applicable laws; and to cooperate with law enforcement or regulatory requests.
Analytics and Improvement: To analyze usage patterns, measure performance, diagnose technical issues, and improve the Service, features, and user experience.
Advertising and Marketing: To deliver and measure targeted advertising, personalize content and recommendations, and promote BuzzStar through our own channels and third-party platforms.
Legal Obligations: To comply with applicable laws, regulations, legal processes, and governmental requests, including tax reporting requirements.
3. HOW WE SHARE YOUR INFORMATION
We may share your personal information with the following categories of recipients:
3.1 Service Providers and Third-Party Partners
Communication Providers: Twilio, Inc. powers video calling, voice, and messaging features. Your communications data (including metadata, call content, and messaging data) may be processed by Twilio in accordance with its privacy policy and Acceptable Use Policy.
Payment Processors: Stripe, PayPal, Apple Pay, and other payment partners process your transactions. They receive payment details necessary to complete transactions and perform fraud screening.
Analytics Providers: Google Analytics, Firebase, and similar services receive usage, device, and interaction data to help us analyze and improve the Service.
Advertising Partners: Meta (Facebook) SDK and other advertising partners receive device identifiers, usage data, and conversion events to deliver and measure targeted advertising.
Cloud and Hosting Providers: We use third-party cloud infrastructure to store and process data, including Recordings and User Content.
3.2 Other Users
Certain information (such as your username, profile photo, and publicly shared Content) is visible to other users of the Service. Recordings may be shared within the app and on social media as described in our Terms of Use.
3.3 Legal and Safety Disclosures
We may disclose your information if required by law, regulation, legal process, or governmental request, or if we believe in good faith that disclosure is necessary to: (a) protect the rights, property, or safety of BuzzStar, our users, or the public; (b) detect, prevent, or address fraud, security, or technical issues; (c) enforce our Terms of Use; or (d) respond to an emergency involving danger of death or serious physical injury.
3.4 Business Transfers
In the event of a merger, acquisition, reorganization, bankruptcy, or sale of all or a portion of our assets, your personal information may be transferred to the acquiring entity. We will notify you of any such change in ownership or control of your personal information.
3.5 With Your Consent
We may share your information for other purposes with your explicit consent or at your direction.
4. DATA RETENTION
We retain your personal information for as long as necessary to fulfill the purposes described in this Policy, including:
Account data is retained for the duration of your account and for a reasonable period thereafter to comply with legal obligations, resolve disputes, and enforce our agreements.
Recordings and User Content are retained in accordance with the license granted in our Terms of Use and may be retained indefinitely for promotional, archival, legal compliance, and dispute resolution purposes.
Transaction records are retained as required by applicable tax, financial reporting, and legal requirements.
Analytics and log data are generally retained for up to 26 months, unless a longer retention period is required by law or for legitimate business purposes.
When personal information is no longer needed, we will securely delete or anonymize it in accordance with our data retention practices.
5. COOKIES AND TRACKING TECHNOLOGIES
We and our third-party partners use the following types of cookies and tracking technologies:
Essential Cookies: Required for the Service to function (e.g., authentication, security, session management). These cannot be disabled.
Analytics Cookies: Used by Google Analytics and Firebase to collect usage data, measure performance, and understand how users interact with the Service.
Advertising Cookies: Used by Meta (Facebook) SDK and other advertising partners to deliver targeted ads, measure ad effectiveness, and build audience profiles.
Preference Cookies: Used to remember your settings, language preferences, and personalization choices.
You can manage cookie preferences through your browser or device settings. Disabling certain cookies may affect the functionality of the Service. For mobile advertising, you can opt out of personalized ads through your device settings (e.g., "Limit Ad Tracking" on iOS or "Opt Out of Ads Personalization" on Android).
6. YOUR RIGHTS AND CHOICES
6.1 General Rights (All Users)
Access and Portability: You may request a copy of the personal information we hold about you.
Correction: You may update or correct inaccurate personal information through your account settings or by contacting us.
Deletion: You may request deletion of your account and associated personal information, subject to our legal retention obligations and the surviving licenses described in our Terms of Use.
Communication Preferences: You may opt out of promotional communications by following the unsubscribe instructions in any promotional message, replying "STOP" to SMS messages, or adjusting your notification settings in the app.
Location: You may disable precise location collection through your device settings.
6.2 California Residents — CCPA/CPRA Rights
If you are a California resident, the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), provides you with the following additional rights:
Right to Know: You have the right to request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources, the business or commercial purposes for collection, and the categories of third parties with whom we share your information.
Right to Delete: You have the right to request deletion of your personal information, subject to certain legal exceptions.
Right to Correct: You have the right to request correction of inaccurate personal information.
Right to Opt Out of Sale/Sharing: You have the right to opt out of the "sale" or "sharing" of your personal information for cross-context behavioral advertising purposes. To exercise this right, contact us at support@buzzstar.io or use the "Do Not Sell or Share My Personal Information" link (if available) on our website.
Right to Limit Use of Sensitive Personal Information: You may request that we limit the use and disclosure of your sensitive personal information to purposes necessary to provide the Service.
Non-Discrimination: We will not discriminate against you for exercising your CCPA/CPRA rights.
To submit a CCPA/CPRA request, contact us at support@buzzstar.io. We will verify your identity before processing your request. You may also designate an authorized agent to act on your behalf.
Categories of Personal Information Collected (preceding 12 months): Identifiers (name, email, phone, IP address, device IDs); commercial information (transaction history, payment details); internet/electronic activity (usage data, browsing history, cookies); geolocation data; audio, visual, and audiovisual information (Recordings); professional information (Influencer verification data); and inferences drawn from the above.
6.3 European Economic Area, United Kingdom, and Switzerland Residents — GDPR Rights
If you are located in the European Economic Area (EEA), United Kingdom (UK), or Switzerland, the General Data Protection Regulation (GDPR) and applicable local data protection laws provide you with the following rights:
Legal Bases for Processing: We process your personal data on the following legal bases: (a) your consent (e.g., for marketing communications, precise location, and cookies); (b) performance of a contract (e.g., providing the Service under our Terms of Use); (c) legitimate interests (e.g., fraud prevention, security, analytics, and service improvement), balanced against your rights; and (d) compliance with legal obligations.
Right of Access: You have the right to obtain confirmation of whether we process your personal data and to access that data.
Right to Rectification: You have the right to request correction of inaccurate or incomplete personal data.
Right to Erasure ("Right to Be Forgotten"): You have the right to request deletion of your personal data in certain circumstances, subject to legal exceptions and the surviving licenses in our Terms of Use.
Right to Restriction of Processing: You have the right to request restriction of processing in certain circumstances (e.g., while we verify accuracy of your data).
Right to Data Portability: You have the right to receive your personal data in a structured, commonly used, machine-readable format and to transmit it to another controller.
Right to Object: You have the right to object to processing based on legitimate interests or for direct marketing purposes.
Right to Withdraw Consent: Where processing is based on consent, you may withdraw consent at any time without affecting the lawfulness of prior processing.
Right to Lodge a Complaint: You have the right to lodge a complaint with your local data protection supervisory authority.

International Data Transfers: Your personal data may be transferred to and processed in the United States and other countries outside the EEA/UK. We rely on appropriate safeguards, such as Standard Contractual Clauses approved by the European Commission, to ensure adequate protection of your data during international transfers.
7. CHILDREN'S PRIVACY
The Service is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If we become aware that we have collected personal information from a child under 13, we will take steps to promptly delete such information and terminate the associated account. If you believe a child under 13 has provided us with personal information, please contact us immediately at support@buzzstar.io. Users between the ages of 13 and the age of majority in their jurisdiction must have parental or legal guardian consent to use the Service.
8. DATA SECURITY
We implement commercially reasonable administrative, technical, and physical security measures designed to protect your personal information from unauthorized access, disclosure, alteration, and destruction. These measures include encryption of data in transit and at rest, access controls, regular security assessments, and employee training. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security. You are responsible for maintaining the security of your account credentials.
9. THIRD-PARTY LINKS AND SERVICES
The Service may contain links to third-party websites, applications, or services that are not owned or controlled by BuzzStar. This Policy does not apply to such third-party services. We encourage you to review the privacy policies of any third-party service before providing your personal information. We are not responsible for the privacy practices or content of third-party services.
10. DO NOT TRACK SIGNALS
Some browsers transmit "Do Not Track" (DNT) signals. There is currently no industry standard for how companies should respond to DNT signals. At this time, we do not respond to DNT signals. However, you can manage tracking through cookie settings and device-level advertising controls as described in Section 5.
11. CHANGES TO THIS PRIVACY POLICY
We may update this Policy from time to time to reflect changes in our practices, technologies, legal requirements, or other factors. When we make material changes, we will notify you by posting the updated Policy on the Service with a revised "Effective Date" and, where required by law, by providing additional notice (such as email or in-app notification). Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Policy.
